Frequently asked questions
What is the difference between a data notice and a notice of use?
A data notice enters in the register the data of a building built before the Building Act — no permit is issued, the data is simply corrected. A notice of use is the notification of putting a later building into use. Which one is suitable depends on when the building was built and what is already in the register.
Can an old house be legalised with this notice?
If the house was built before the Building Act came into force and has not been substantially altered since, usually yes. For later conversions, a notice of use or an occupancy permit may be needed.
Can the local authority reject the notice?
The local authority checks the data and may ask for additional documents, such as an as-built survey or an audit. The project manager answers the questions and arranges the missing documents.
